Thank you for entering the Designs by Marius Win a Dress competition. Please read the terms and conditions.
1. DEFINITIONS
1.1 “You”, “Your”, or “Entrant” means each person who wishes to enter or has entered the Competition;
1.1 “The Wedding Show” means The Wedding Show exhibition 2023.
1.2 “Competition” means the The Wedding Show & Designs by Marius bridal dress competition on Instagram and Facebook;
1.3 “Rules” means the rules of the Competition as set out herein; and
1.4 “Prizes” means 1 prize in total and comprising the following:
1.4.1 A wedding dress package to one individual to the value of R50,000
2. RULES FOR THE COMPETITION
2.1 Introduction
2.1.1 The Competition is subject to these Rules. Each Entrant, by entering the Competition, expressly acknowledges that he or she has read these Rules and thereby accepts and agrees to be bound by the Rules.
2.1.2 It is the responsibility of each Entrant to read the Rules and pay special attention to all the terms printed in bold.
2.2 Process for entering the Competition on Facebook and Instagram
2.2.1 To enter the Competition, and stand a chance to win, you must enter in the comments section of the post on Facebook or Instagram, tag 3 of your friends or family members as well as share the post to your stories.
2.2.2 Entries submitted via a private message will not be considered eligible for participation in the Competition and will be disregarded.
2.2.3 Only one entry, per Entrant, will be valid as per point 2.2.2 above. 2.2.4 In order to qualify as an Entrant, you must –
2.2.4.1[be 18 years or older];
2.2.4.2 reside in the Republic of South Africa; and should you be outside the Johannesburg areas, any travel, transport or courier costs will be for your own account in order to receive the prize. Designs by Marius has offered virtual fittings for winners outside Johannesburg who cannot travel.
2.2.4.3 Submit a valid entry through Facebook or Instagram which complies with these Rules, between 12 May and by midnight on 16 July (“the Closing Date”);
2.2.5 All entries must be completed on or before the Closing Date and time. All entries completed after the Closing Date, or that do not comply with these Rules, will be invalid and will not be eligible for participation in the Competition.
2.2.6 A groom, family member or friend can enter on behalf of a bride. 2.3 Determination of the winner;
2.3.1 There will only be 1 winner, who will be randomly selected, from valid entries on The Wedding Show’s Instagram and Facebook page for this Competition, using an independent third-party computer programme or website. For the avoidance of doubt, it should be noted that an Entrant may not win more than one Prize in respect of this Competition.
2.3.2 The winner will be notified on Instagram or Facebook and will be requested to confirm their contact and delivery details within 72 hours of being requested to do so.
2.3.3 It is the winner’s responsibility to ensure that their contact details provided to The Wedding Show & Designs by Marius are complete and correct.
2.3.4 Both Designs by Marius as well as the owners of The Wedding Show are allowed to use images as well as personal information such as the bridal parties Names and surnames on all social media platforms (upon announcing winner) without any permission or remuneration.
2.4 Prizes
2.4.1 The Wedding Show & Designs by Marius reserves the right to alter the Prizes at any time during the Competition and after the Closing Date and at its sole discretion, without any notice to the Entrants.
2.4.2 The Prize is non-transferable and may not be deferred, changed, or exchanged for cash or any other item, by any person other than the announced winner. Consultation and fittings to be held at the Designs by Marius studio in Vanderbijlpark only. This prize is a wedding dress package to be used only at Designs by Marius and only for Bridal attire including Bridal dress, veil, Mother of the bride and Bridesmaid dresses
2.4.3 To the extent that any taxes, duties, levies or other charges may be levied on the Prize by any governmental, regulatory body or tax authority, or become payable by the winner to any governmental, regulatory body or tax authority, then such winner will be solely liable for the payment thereof. The Wedding Show & Designs by Marius will not increase the value of the Prize to compensate for such taxes, duties, levies or other charges.
2.4.4 Subject to applicable laws, each Entrant agrees to accept the Prize “as is”.
2.4.5 The Wedding Show & Designs by Marius makes no representation or warranty, whether express, tacit or implied, regarding the Prizes other than as may be expressly contemplated in these Rules.
2.4.6 Ownership of, risk in and benefit to any Prize will pass to the winner of a Prize upon delivery of the Prize to such winner.
2.4.7 Any costs or expenses incurred by a winner in respect of items not specifically included in a Prize shall be for the winner’s own account. The Wedding Show & Designs by Marius will not under any circumstance be responsible for any direct or indirect expenses which the winner may incur as a result of their acceptance and/or use of a Prize, whether such expenses are foreseeable or not.
2.4.8 The Designs by Marius team will only Design and Manufacture the clothing for the bridal Party. We will not attend the wedding or be present to dress the bride or her bridal party on the day of the wedding.
2.4.9 Consultation to be done before 31 July 2024 and Wedding no later than 31 July 2025.
2.4.10 The bride and her bridal party is responsible for their own transport to and from fittings and consultations with Designs by Marius team.
2.4.11 Consultations and Fittings to be booked only with Marius de Jager, Owner and Head designer at Designs by Marius.
2.5 General
2.5.1 Any and all decisions made by The Wedding Show & Designs by Marius in relation to the administration, application and interpretation of these Rules shall be final and binding on all Entrants, and no
correspondence will be entered into with Entrants regarding such decisions.
2.5.2 These Rules may be amended, without notice to the Entrants, at any time during the Competition. Such altered Rules and/or any substituted prizes shall become effective immediately after being published by The Wedding Show & Designs by Marius. No Entrant shall have any recourse of any nature whatsoever against The Wedding Show & Designs by Marius as a result of any alterations to these Rules or Prizes.
2.5.3 Entrants are obliged to comply with all applicable laws, including, without limitation, those laws protecting the intellectual property rights of other Entrants and parties.
2.5.4 The Wedding Show & Designs by Marius reserves the right to remove any content or comment from its Facebook page without notice to the person who published such content or comment, if The Wedding Show & Designs by Marius, in its sole discretion, determines that such content or comment:
2.5.4.1 violates these Rules;
2.5.4.2 is unlawful, misleading, discriminatory, defamatory or fraudulent;
infringes or violates someone else’s rights, including their intellectual property rights;
2.5.4.3 does not relate to the Competition; or
2.6.4.4 is inappropriate for any other justifiable reason as determined by The Wedding Show & Designs by Marius.
2.5.5 These Rules are governed by the laws of the Republic of South Africa and any dispute or claim between The Wedding Show & Designs by Marius and any Entrant in relation to these Rules shall be subject to the jurisdiction of the South African courts.
2.5.6 In the event that any part of these Rules is deemed by a court of competent jurisdiction or any regulatory authority, to be invalid, illegal or unenforceable, then only that relevant part will be considered invalid and will no longer apply, while all the remaining provisions of these Rules will continue to be valid and in force to the greatest extent permitted by law.
2.5.7 All personal information relating to an Entrant will be processed by The Wedding Show & Designs by Marius in accordance with applicable law and the provisions of the Protection of Personal Information Act 4 of 2013.
2.5.8 By entering into the Competition, each Entrant thereby consents to his/her personal information being shared with The Wedding Show & Designs by Marius’s employees, contractors and agents for purposes of this Competition.
2.5.9 The Wedding Show & Designs by Marius, its directors, members, officers, partners, agents, consultants and employees, the suppliers of any goods and services in connection with the Competition and their respective spouses, life partners, business partners or immediate family members are not permitted to participate in the Competition. The Wedding Show & Designs by Marius reserves the right to verify the eligibility of all Entrants at any time.
2.5.10 The Wedding Show & Designs by Marius reserves the right to extend, shorten or suspend the time period of the Competition in its sole discretion for technical, commercial, or operational reasons, for the greater public good, due to a “force majeure event”, or generally for any reason of comparable magnitude which impacts on the administration of the Competition. In these circumstances, The Wedding Show & Designs by Marius shall endeavour to notify Entrants by publishing a written notice on its website, Facebook page, as the case may be, as soon as reasonably possible.
3. The Wedding Show & Designs by Marius’ Role & Responsibility
To the extent legally permissible and in the absence of gross negligence or fraud on the part of The Wedding Show & Designs by Marius
3.1 The Wedding Show & Designs by Marius assumes no liability whatsoever for any direct or indirect loss, harm or damage, including consequential and economic loss, arising from or in connection with or as a result of any Entrant’s participation in the Competition; and
3.2 each Entrant irrevocably and unconditionally indemnifies The Wedding Show & Designs by Marius and shall hold The Wedding Show & Designs by Marius harmless against any loss, cost, damage, expense, harm or claim, whether direct or indirect, of any nature arising from, in connection with or as a result of his or her participation, in any way whatsoever, in the Competition.
3.3 All entrants in the competition give The Wedding Show and Designs by Marius permission to add their email address to the event mailing lists in order to be kept up-to-date with the latest happenings. These addresses will not be sold or given to a third party in terms of the POPI act.
